Terms and Conditions

Article 1: Application and Amendment to the Terms and Conditions of Sale

These terms and conditions of sale

apply without exception to all orders through the website http://www.remotecontrol-express.com, even where exceptions are mentioned in the terms and conditions of our clients.
Remote Control Express is a registered trademark of Telecommande Express, the european remote control specialist.
Remote Control Express reserves the right to change or amend the terms and conditions of sale at any moment. In the case of such an amendment, the terms and conditions of sale applicable at the time of ordering will apply.

Article 2: Availability of products

Our range of products and prices are applicable as seen on the website, subject to availability of stock.
On receipt of your order, we will verify the availability of the product(s) ordered.

Where the products are not available, we commit to completing each order within 40 days, either by delivery of the products ordered, or by sending a cheque reimbursing the cost of the order.

The order will be validated on:

  • The date the order was placed when payment is made online using a bank card
  • The date the cheque was received when payment is made by cheque

Where one part of your order is unavailable, we will complete the rest of your order.
Samples:
In line with our partners’ advertising campaigns, you may receive free promotional material in your package. Only one sample per person per order is distributed. Our help line will not process any claim relating to these samples.

Article 3: Validation of orders and electronic signatures

Any order form signed by the consumer by use of a “double click” constitutes an irrevocable acceptance that cannot be revoked except in line with the limitations of these terms and conditions of sale.
The “double click” associated with the process of authentication and non repudiation and to the protection of message integrity constitutes an electronic signature. This electronic signature has the same value to both parties as a written signature.

Article 4: Price

Remote Control Express reserves the right to amend its prices at any moment, while remaining committed to applying the tariffs in force at the time of order.

Prices are given in Euro, inclusive of all taxes, but not including shipping costs. All orders are payable only in Euro. If the order comes from a country outside the EEC, the client is considered to be the importer.
In that case, customs rights, local taxes, importation rights or taxes could be applied. The client is liable for any such right or tax as Remote Control Express does not recognise any responsibility in that regard.

Article 5: Orders

No order will be valid if the client does not complete all the “required fields” on the order form.

Forms of Payment:
Payment can be made by:
bank card:
The payment will be made using secure bank servers belonging to our partner (BNP). Therefore your bank details will not pass through the Remote Control Express website http://www.remotecontrol-express.com. Payment by bank card is therefore completely secure; your order will be registered and validated as soon as payment is accepted by the bank. If the transaction is not validated by the bank, for whatever technical or banking reason, the order will be cancelled automatically.

cheque:
Your order will be reserved for 7 days. If the cheque has not been received within that period, the order will be cancelled. The order will not be processed until the cheque has been received and the order validated.

Security:
The data contained on your credit card is encrypted using the SSL protocol (Secure Socket Layer) and will never be visible unencrypted on the network. Payment is made directly to the bank. Remote Control Express never has access to this data, and neither does it retain that information on its servers. For that reason, the information will be requested each time you complete a new transaction on our site.

Reservation of ownership clause:
Products remain the property of Remote Control Express until payment is received by Remote Control Express. However, as soon as the order is received by the client, the risks related to delivered merchandise are transferred to the client.

Article 6: Delivery methods and times

6.1 - Methods

General Information:
Products will be delivered to the delivery address provided by the client during the order process.

- Delivery by parcel: €8
Deliveries will be sent by parcel. The package is sent by recorded post, i.e. requiring a signature on delivery, to the address indicated by the client. If the client is not at that address at the time of delivery, a notice will be left in the client’s mailbox to the effect that the package will be available for collection at the local branch. If several items are ordered from Remote Control Express, the delivery may be split into several packages. The Client will only be responsible for the payment of one set of delivery costs.

6.2 - Timescale All delivery times are calculated in working days.
The timescales indicated are average times, and correspond to the time required to process, prepare and send your order (dispatch from the warehouse). They run from the moment at which the order is validated.
Actual delivery time must also be added to the timescales indicated.

All articles which are in stock are dispatched within1 to 3 days.

6.3 - Delivery times

The product ordered will be delivered by the common postal service, or by an independent courier, to the address which appears on the order form. The time periods indicated start from the moment at which the package leaves our warehouse. The choice of delivery method depends on the weight, volume and value of the articles.

Delivery method:
Parcel: average delivery time given by the service provider:

  • 2 to 3 days for the UK
  • 15 days for the rest of the world

On delivery of the package:
The Client should verify the contents of the order at the time of delivery, before signing the delivery form provided by the courier.

Any problem with the delivery (such as a damaged product) should be indicated on the delivery form in writing, accompanied by the signature of the Client. On signing the delivery form, it is understood that such a verification of the order has been undertaken by the Client, or another person authorized by the Client.

Any problem with the order should also be confirmed in writing, and by recorded post, to the courier within 3 working days of receipt of the order, and a copy of that letter should also be sent to:

If the products need to be returned to us, please contact our Customer help line and arrange a return request:

  • within 7 days of the delivery for a cancellation
  • within 15 days if the product is defective or if the correct model was not received
  • after the Client indicates an underlying defect which is then verified.

Any request submitted outside these time periods will not be accepted. In the case of a cancellation or if the correct model was not received, the product can only be returned in its original state (packaging, accessories, manual).

If, at the time of delivery, the original packaging is damaged, ripped or open, you should verify the status of the articles contained in the package. If they are damaged, you should refuse delivery of the package and indicate the reason on the delivery form (package refused because it was open or damaged).

Article 7: Responsibilities

Remote Control Express will not be responsible for not fulfilling any contract when the reason is unforeseen external circumstances, particularly in the case of a partial or total strike by postal services, couriers, and catastrophes caused by floods or fires. With regard to products purchased to meet professional needs, Remote Control Express will not be responsible for any indirect damage relating to the contract, loss of use, loss of profit, or damages or costs arising.
The choice and purchase of a product or service remains the sole responsibility of the Client. The partial or total inability to use the products, in particular because of incompatible materials, will not lead to any compensation, reimbursement or responsibility on the part of Remote Control Express, except in the case of a verified fault, non-conformity, defect or the exercise of the right to cancel the contract as provided for in Article 8. If all or part of an order is not delivered, the Client has a maximum of six months (counting from the moment at which the package leaves our warehouse) to notify Remote Control Express. After that time, Remote Control Express will not accept any claims.

Article 8: Right to cancel

The Client has 7 working days from the date of delivery of the order to return all unsuitable articles and demand exchange or reimbursement without penalty, excluding the costs of returning the item(s).

The product must be returned in a perfect state, in its original packaging and undamaged. It should be accompanied by all its accessories. If those terms are not complied with, the Client loses the right to cancel and the product will be returned to the client at their cost.

Costs of return relating to cancellation:
Costs of return in the case of a cancellation of an order are at the expense of the client. In order to ensure that your package can be tracked, we request that any returns are made using parcels that require signature on receipt.

Method of reimbursement:
After receipt and acceptance of the return, we will arrange a reimbursement by cheque. (For greater security, we recommend that you send a letter requesting acknowledgement of receipt) to the following address:

In order to enable us to correctly deal with your request, please state your order number and name and address.

Article 9: Processing of packages: Not known at this address / unclaimed / refused

If your package is returned by our provider for one of the following reasons:
Not known at this address
Package unclaimed in the given period
Package refused by recipient at moment of delivery
After receipt and acceptance of the returned package, we will reimburse you by cheque.
In order to deal with your request correctly, please include your order number and name and address.

Article 10: Exchange

While the choice and purchase of product are the sole responsibility of the purchaser, it is possible to exchange the product within 30 days following the date of dispatch of the product. The inability to use the purchased product for whatever reason, in particular owing to incompatibility with the material already owned by the purchaser, will under no circumstances lead to compensation or the cancellation of a purchase by Remote Control Express if the legal period for such a return has expired.

Error in the Client order:
The product can be exchanged within 10 days of the date of dispatch of the product.
First, the Client should inform Remote Control Express of their mistake by sending an e-mail to: customerservice@remotecontrol-express.com
If there is no response within 2 working days from Remote Control Express, the Client should return the product in its perfect state and in its original packaging.
The client is responsible for postage costs and there is a fixed cost of €10 (inc.taxes) to cover the costs of processing an exchange.
If it is not possible to exchange the product (obsolete product, unavailability of stock) the Client will be reimbursed by cheque to the amount of the order less €10 inc.taxes for postage and packing.

Error in dispatch by Remote Control Express
It will be possible to exchange the product within 30 days of the date of dispatch of the product.
First, the Client should notify Remote Control Express of the error in delivery by sending an e-mail to: customerservice@remotecontrol-express.com
If there is no response within 2 working days from Remote Control Express, the Client should return the product using the a parcel that requires a signature on delivery in its good state and in its original packaging.
If it is not possible to exchange the product (obsolete product, unavailability of stock) the Client will be reimbursed to the amount of the order and the costs for returning the merchandise (on the basis of a return using a standard parcel recorded delivery).

Article 11: Guarantee

Products have a guarantee of 3 months.
The guarantee will be strictly limited to the replacement of items with a manufacturing defect that has been clearly established.
The guarantee dates from the moment of delivery or availability for use.
The products sold are guaranteed against any defect or manufacturing fault, except:
Du remplacement des consommables (batteries)
The abnormal or unusual use of the products (we encourage you in this regard to carefully consult the instructions for use provided with the products)
Any defects and their consequences resulting from repair unauthorised by the manufacturer, defects and their consequences related to any use of the product not in line with the intended use of the product (professional or collective use, etc.)
Defects and their consequences related to any external cause, in particular exposure of the products to water, heat or the sun, not in line with the instructions for use of the products.
Remote Control Express has no responsibility in cases where the article delivered is not in line with the legislation of the country of delivery.

Article 12: Return under guarantee

Return of items is accepted by Remote Control Express under the following conditions:
The Client should request authorisation by email for a return from Remote Control Express after sales service; e-mail: customerservice@remotecontrol-express.com
If there has been no response from Remote Control Express within 2 working days, the Client should return the merchandise which should be in a good state and in its original packaging.
All returns should be accompanied by a copy of the initial receipt of purchase.
Only postage paid returns will be accepted.
If the item is assumed to be defective, information regarding the exact motives and details of the return should be included.
The guarantee provides for Remote Control Express to either:
Replace the item if it is defective.
Repair the item if Remote Control Express recognises that it is defective.

Article 13: Personal information

In accordance with Law no. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, the Client has the right to access, modify and remove personal information concerning themselves. The Client should address all queries in this regard to Remote Control Express by writing to the following address:

Article 14: Dispute:

This contract is in accordance with French law, both in form and substance.
In case of litigation, in the absence of an amiable agreement between parties, jurisdiction is awarded to the courts in the town where Remote Control Express is registered, despite appeals for a third party or the existence of several defenders, even in emergency procedures or precautionary procedures for relief or injunction.
